TERMS AND CONDITIONS OF TOURIST RENTAL – INSPECTION-READY VERSION

Vacation Home – Canary Islands

1. Owner and Property Identification

The OWNER is the registered holder of the vacation home located at Calle Acatife, 5, Puerto del Carmen, Lanzarote, registered in the General Tourist Registry of the Canary Islands, in accordance with Decree 113/2015 of May 22.

Full identification details, including the tourism registration number, are available on the website and in the property documentation.


2. Purpose of the Contract

The OWNER grants the GUEST the temporary use of the vacation home, exclusively for tourist purposes, during the dates specified in the confirmed reservation.

This agreement does not constitute a rental for permanent housing and is not governed by the Urban Lease Act.


3. Duration of Stay and Occupancy

  • Check-in: from 17:00 hours on the day specified in the reservation.
  • Check-out: until 10:00 hours on the day specified in the reservation.

Maximum occupancy is limited to the number of persons authorized in the tourism registration and reflected in the reservation. Entry or overnight stay of unregistered persons is strictly prohibited.


4. Price and Payment Terms

  • Total price of the stay: as indicated in the confirmed reservation, including taxes.
  • For the reservation to be considered confirmed, the GUEST must pay a 25% deposit of the total amount at the time of booking.
  • The remaining 75% must be paid at least 15 days prior to check-in.
  • Payment methods: bank transfer, card, or cash, as indicated in the reservation.
  • Failure to comply with these payment deadlines may result in the automatic cancellation of the reservation without refund of the initial deposit.
  • Full payment: must be made prior to check-in.

Security Deposit

A €500 security deposit is required before check-in.
This amount will be refunded via bank transfer within 9 calendar days after check-out, once the property has been inspected and compliance with all rules verified.


5. Cancellation Policy

Cancellations within the deadlines indicated in the reservation will follow the terms accepted at booking.
Outside these deadlines, no refunds will be provided, including no-shows.

6. Rules of Use, Conduct, and Safety

In accordance with Decree 113/2015, the GUEST agrees to:

  • Respect coexistence and rest rules, and use the property responsibly.
  • Keep the property, furniture, and facilities in proper condition.
  • Not host parties, events, or celebrations that may cause nuisance or danger.
  • Not allow entry or overnight stay of unregistered persons.
  • Comply with municipal and regional regulations.
  • No pets allowed.
  • Smoking is strictly prohibited inside the home, covered terraces, or enclosed areas.
  • The use or possession of illegal substances is strictly prohibited anywhere on the property.
  • Follow all instructions regarding safety equipment, alarms, gates, and pool rules.

Specific Pool Area Rules

For strict safety reasons:

  • Glass containers are strictly prohibited in the pool area.
  • Use, handling, or introduction of glass bottles, glasses, or other glass objects in the pool area is forbidden.

Violation of these rules constitutes a serious breach and may result in:

  • Financial penalties for damage or extraordinary cleaning.
  • Immediate termination of the stay without refund.

Additionally, guests must take extreme care of keys and the gate remote; loss incurs a €100 penalty.

Noise and Neighborhood Conduct

  • Noise must be kept to a reasonable level at all times.
  • Complaints from neighbors may lead to warnings or termination of the stay without refund.
  • Any illegal or dangerous activity will be reported to authorities immediately.


7. Guest Registration

The GUEST must provide accurate personal information for all occupants in compliance with guest registration regulations.
Failure to provide this information will prevent access to the property.


8. Liability and Exoneration

  • The GUEST is responsible for any damage caused to the property or its facilities.
  • The OWNER is not responsible for loss, theft, or misplacement of personal belongings.
  • Use of the pool, jacuzzi, and other facilities is at the guest's sole responsibility.
  • The OWNER is exonerated from liability for accidents or injuries resulting from non-compliance with rules, reckless behavior, or illegal activities.


9. Complaint Forms

The property provides official complaint forms, available to guests, in accordance with Canary Islands consumer protection regulations.


10. Data Protection

Personal data will be processed according to EU Regulation 2016/679 (GDPR) and Spanish law, exclusively for reservation management, legal obligations, and communication with the guest.

11. Governing Law and Jurisdiction

This agreement is governed by Spanish law and the Canary Islands tourism regulations, including Decree 113/2015.

For any disputes, parties submit to the courts of Arrecife (Lanzarote), without prejudice to consumer rights.


12. Acceptance

Booking the property constitutes the GUEST’s express acceptance of these Terms and Conditions.
